The Centers for Medicare and Medicaid Services (CMS) issued a Home and Community-Based Services (HCBS) final rule on January 16, 2014, which came into effect on March 17, 2014. The new rule applies to both residential and non-residential settings and changes the standards by which states are allowed to pay for HCBS. Highlights of the new rule include the following:
Ensuring that individuals have been given choices regarding their setting options.
Guaranteeing individuals’ rights of privacy, dignity, respect, and freedom from coercion and restraint.
Optimizing autonomy and independence in making life choices
Facilitating choice in services and those who provide it.

Review of Senior Center Plus Sites and Determination: No Sites Submitted to CMS for Heightened Scrutiny Review
The Maryland Department of Health has reviewed the Senior Center Plus sites in the state and has found that currently all of the sites are community based and meet the criteria of the Community Settings regulations. The Maryland Department of Health invites public comment on the Senior Center Plus providers. A public comment period will be open from May 25, 2018 to June 25, 2018. Once the public comment period is complete, this information and the comments will be submitted to CMS for review. Please send all comments to

List of Adult Medical Day Care Sites to be Submitted CMS for Heightened Scrutiny Review
The following Medical Adult Daycare (MADC) sites were identified as falling under the heightened scrutiny (HS) designation due to the reasons listed. A public comment period was implemented from May 25- June 25, 2018.
Please note that although the public comment period prior to the submission of the list to CMS has ended, MDH will accept comments about this list and providers at all times and include them in future updates of the STP and to CMS. Please email

and include “Public Comment-HS” in the subject line.
